Lawsuit Filed Over NJ Plant Explosion

As reported by the Hartford Courant, a former employee at the Kleen Energy power plant in New Jersey has filed a lawsuit against the plant owners over injuries he sustained during a gas blowout in February.

Nicholas Novik claims in his lawsuit that he and other workers should not have been required to be on site during a dangerous procedure known as a “gas blow.”

The explosion killed six workers and Novik suffered a serious head injury and permanent brain damage. An OSHA investigation found the conditions during the gas ventilation were “deadly” and the owners committed numerous safety violations.

The Wall Street Journal is reporting that Wal-Mart Stores, Inc. is facing a class-action lawsuit suit in Colorado asserting that it sought to limit the rights of injured workers in its stores.

The plaintiffs have asserted that Wal-Mart conspired to set limits on medical care for injured workers for financial reasons. The suit, which was filed last year in US District Court for Colorado, accuses Wal-Mart and American Home Assurance Co. of breaking federal and state laws by using Claims Management Inc., to manage treatment for employees injured in the workplace.

Injured employees were then sent to Concentra, Inc. which runs workplace clinics in many states. The suit alleges that the company conspired to dictate medical care for injured employees, a violation of Colorado worker’s compensation law.

$2.3 Million Fine For Workplace Injury Rule Violations

The Transportation Department’s Pipeline and Hazardous Materials Safety Administration just issued the largest fine in its history for workplace safety violations against a pipeline company.
