Wrongful Death
Wrongful death actions often result from car accidents, workplace injuries, defective products, and slip and falls, trip and falls, and other premises liability issues.
When you are dealing with the death of a loved one due to the wrongful act of another or the negligence of a corporation, you will have many questions. On this site, as well as my others, I try and answer some of those questions about wrongful death actions and lawsuits.
In California, the law establishes a cause of action in favor of specific heirs in a wrongful death action. Under this cause of action, those heirs are entitled to recover damages for the losses that they have sustained due to the injury victim’s death.
Some of the damages that can be pursued in a wrongful death action may include:
• Medical expenses paid by the claimant on behalf of the decedent
• Loss of society, enjoyment, and consortium of the decedent
• Loss of potential earnings of the decedent
• Any additional economic loss sustained due to the death of the victim
California law also allows for the injury victim’s estate to pursue damages through a survival action. These damages descend through the estate and may include medical and other expenses incurred by the victim prior to death.
When you are considering a wrongful death lawsuit, you need serious legal representation. I can provide that representation with confidence, commitment, and empathy.
